Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the College Fit Project service (the “Service”) operated by CollegeFitProject LLC, a Delaware limited liability company (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. Users between the ages of 13 and 17 represent that they have obtained the permission of a parent or legal guardian to use the Service. We reserve the right to terminate any account if we have reason to believe the account holder is under the age of 13.

2. Accounts

2.1 Account Creation

You must create an account to access most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

2.2 Account Limits

Each account supports one user login and up to 3 student profiles. These limits may be adjusted in the future.

2.3 Accurate Information

You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date.

3. The Service

3.1 Description

The College Fit Project helps students and families organize and evaluate college options based on personalized factors and weights. The Service provides informational and organizational tools only.

3.2 Not Professional Advice

THE SERVICE IS AN INFORMATIONAL TOOL ONLY. IT DOES NOT CONSTITUTE COLLEGE COUNSELING, ADMISSIONS ADVICE, FINANCIAL AID ADVICE, OR ANY OTHER PROFESSIONAL SERVICE.

Fit scores and rankings are generated algorithmically from data you provide and publicly available datasets. We make no representations about the accuracy, completeness, or fitness for any particular purpose of the data or scores presented. You should always consult qualified professionals—including licensed college counselors and financial advisors—for decisions related to college admissions and financial planning.

3.3 Third-Party Data

Certain factor values are populated from third-party sources, including the U.S. Department of Education College Scorecard, NOAA climate data, and Clery Act campus safety reports. We do not guarantee the accuracy, completeness, or timeliness of this data. Data may lag behind current institutional information.

4. Payment and Billing

4.1 Fees

Certain features of the Service require payment. Applicable fees are displayed before purchase. All fees are stated in U.S. dollars and are non-refundable except as set forth below or as required by applicable law.

4.2 Payment Processing

Payments are processed by Stripe, Inc. By providing payment information, you authorize us to charge the applicable fees to your payment method. We do not store your payment card details. Your use of Stripe’s services is also subject to Stripe’s Terms of Service.

4.3 Refund Policy

All sales are final. If you believe you were charged in error, contact us at legal@collegefitproject.com within 30 days of the charge and we will review your request.

5. User Content

5.1 Ownership

You retain ownership of data you enter into the Service, including student names and manually entered factor values (“User Content”). By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely as necessary to provide the Service to you.

5.2 Responsibility

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to submit your User Content and that it does not violate any applicable law or third-party rights.

6. Prohibited Uses

You agree not to use the Service to:

Violate any applicable local, state, national, or international law or regulation.
Attempt to gain unauthorized access to any portion of the Service or its related infrastructure.
Scrape, crawl, or extract data from the Service in an automated fashion without our express written permission.
Reverse engineer, decompile, or disassemble any portion of the Service.
Transmit malware, viruses, or other harmful or disruptive code.
Impersonate any person or entity or falsely state your affiliation with any person or entity.
Interfere with or disrupt the integrity or performance of the Service.

7. Intellectual Property

The Service and all content and software associated with it, including its design, text, graphics, and code, are owned by CollegeFitProject LLC and are protected by U.S. and international copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it as provided herein.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting us at legal@collegefitproject.com. Upon termination for any reason, your right to use the Service ceases immediately. Sections 3.2, 9, 10, 11, and 13 of these Terms survive termination.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any data presented through the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CollegeFitProject LLC and its members, managers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or loss of goodwill, arising from or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising from or related to these Terms or the Service shall not exceed the greater of (a) the total amount you paid us in the twelve (12) months preceding the claim or (b) one hundred U.S. dollars ($100).

Without limiting the foregoing, we shall have no liability whatsoever for any claim arising from the inaccuracy, incompleteness, staleness, or unavailability of any data, factor value, fit score, or other information presented through the Service, including data sourced from third parties such as the U.S. Department of Education, NOAA, or Clery Act reports.

11. Indemnification

You agree to indemnify, defend, and hold harmless CollegeFitProject LLC and its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; or (c) your violation of these Terms or any applicable law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the “Last Updated” date. If you continue to use the Service after the changes take effect, you accept the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you irrevocably consent to personal jurisdiction in those courts.

14. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CollegeFitProject LLC regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15. Service Changes and Discontinuation

CollegeFitProject LLC reserves the right to modify, suspend, or discontinue the Service (or any part of it) at any time. If we decide to permanently discontinue the Service, we will:

Provide advance notice. We will notify you by email at least 30 days before the discontinuation date.
Allow data export. During the 30-day notice period, you will have the ability to export your data (student profiles, college lists, and factor values) in a downloadable format. After the discontinuation date, your data will be permanently deleted and cannot be recovered.

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service, provided we follow the notice and data export procedures described above.
